    A seemingly quiet year. We have enjoyed the major win in legislation and can now advertise in any commercially reasonable manner. Taken directly from House Bill 1138

                    After the expiration of the time given in the owner's notice, the owner shall publish * * * advertisement of the sale to the highest bidder in * * * any commercially reasonable manner.  The manner of advertisement is deemed commercially reasonable if it is likely to attract at least three (3) independent bidders to attend or view the sale in person or online at the time and place advertised.  The notice shall include the address of the self-storage facility where the personal property is located, and the name of the occupant, and the time, place and manner of the sale. 

              (d)  A sale to the highest bidder shall take place not sooner than fifteen (15) days after the publication. * * *

              (e)  If no one purchases the property at the sale and if the owner has complied with the foregoing procedures, the owner may otherwise dispose of the property. * * *

    If you haven’t already, we recommend jumping on the online bandwagon. Try an online auction website to advertise, kick your social media presence up a notch, or link up with your local Chamber of Commerce. Get the public excited for your auctions so that you can recoup as much lost revenue as you can.

    New Year, New Look

    The association has had a major overhaul that last few months of the year. Heather McCombs, our new Executive Director, has taken over and has updated the association to be more in line with sister associations to better help owners and operators. Our website has received a new look and we are excited for a new logo design in 2022. With coming changes there are inevitable adjustments, we apologize for any delay in response times. Changes will be ongoing, and we would love to hear from you, please contact Heather at contact.msssoa@gmail.com.

    What to Expect

    We are hopeful that for our 20th anniversary in 2022 we can excel in what our members expect from an association. Member pricing will change and so will the benefits, including documents, events, and community reach. We are actively looking for speakers and vendors for events and volunteers for our new Ambassador program.

    Despite the current economic situation, we are excited to announce that Governor Tate Reeves has signed legislation that significantly improves the Mississippi self storage lien law.

    Most significantly, the new law eliminates the costly newspaper advertising requirement and allows for online advertising or other alternatives that draw at least three independent bidders to the auction. It also eliminates the certified mail requirement and allows operators to send lien notices by verified mail (also referred to as U.S. mail with certificate of mailing) or by email, if elected by the tenant in the rental agreement. These changes will result in significant savings for your facility and boost your NOI.

    The bill also expressly allows for online auctions; allows for optional towing in lieu of selling vehicles and watercrafts; establishes a late fee safe harbor of $20 or 20% of the monthly rent, whichever is greater; and provides legal protection for the stored property value limitations common to many self storage rental agreements.

    The national Self Storage Association is preparing a lien law manual that explains the new law, and includes checklists, timelines, and sample lien notices. As an affiliate of the national SSA, Mississippi members can purchase the manual at a discounted member rate.

    In addition, the MsSSOA is working with self storage attorneys to update the standardized lease agreement and lien documents typically included in the Membership Documents Bundle.
